Service Agreement
1. About this agreement
This Service Agreement (Agreement) is a legally binding contract between you (Customer) and TradeBird (ABN 88 925 254 294), located at QLD 4221 (TradeBird, we, us, our), governing your use of the TradeBird service.
By signing up for TradeBird, completing the onboarding process, or using any part of the service, you agree to be bound by this Agreement. If you are signing up on behalf of a business, you confirm that you have authority to bind that business to these terms.
Please read this Agreement carefully. If you do not agree to these terms, do not use TradeBird.
2. The TradeBird service
TradeBird is an AI-powered missed-call response and lead-qualification platform built for Australian trade businesses. When a potential customer calls your business number and the call goes unanswered, TradeBird automatically sends that caller an SMS on your behalf, engages them in a structured conversation, qualifies the job enquiry using artificial intelligence, and delivers the resulting lead to your TradeBird dashboard.
The service includes:
- Automated SMS lead capture — outbound SMS sent to missed callers via your nominated TradeBird number.
- AI-powered lead qualification — inbound caller responses are processed by an AI model to extract job type, contact details, location, and timing preferences.
- Dashboard access — a web-based dashboard where you can view all leads, read conversation transcripts, update lead status, and manage your account.
- Integration with your job management system — where configured, qualified leads can be pushed automatically into your existing job management software (subject to the plan you are on and any applicable integration requirements).
TradeBird is designed to capture and qualify leads. It does not book jobs, issue quotes, or interact with callers beyond the initial qualification conversation unless additional features are explicitly enabled and described in your plan.
3. Subscription plans and pricing
TradeBird is offered on a monthly subscription basis. The following plans are available:

All prices are in Australian dollars. TradeBird reserves the right to change plan pricing with at least 30 days' written notice to active subscribers.
4. Free first month
New customers are entitled to one free calendar month of TradeBird at the plan level they sign up for. No payment is required during the free month. At the end of the free month, your subscription will automatically continue at the applicable monthly price unless you cancel before the free month expires.
The free first month is available once per business. Creating multiple accounts to access additional free months is a breach of this Agreement.
5. Payment terms
Following the free first month, your subscription is billed monthly in advance on the same date each month. Payment is processed automatically using the payment method you provide during sign-up.
- If a payment fails, we will attempt to retry the charge. If payment remains outstanding after two retry attempts, your account may be suspended until the outstanding amount is paid.
- You are responsible for ensuring your payment details are current and valid.
- All fees are non-refundable except as required by Australian Consumer Law or as expressly stated in this Agreement.
- A tax invoice will be issued for each successful payment and made available through your dashboard.
6. Customer responsibilities
You are responsible for:
- Providing accurate information — ensuring that your business details, phone number, and service configuration provided during onboarding are accurate and kept up to date.
- Monitoring your dashboard — regularly checking the TradeBird dashboard for new leads and responding to qualified enquiries in a timely manner. TradeBird captures and qualifies leads; following up with those leads is your responsibility.
- Complying with applicable law — ensuring that your use of TradeBird, including the sending of automated SMS messages on your behalf, complies with the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth), and any other applicable Australian laws.
- Securing your account — keeping your dashboard login credentials confidential and notifying us immediately if you suspect unauthorised access.
- Not misusing the service — not using TradeBird for any unlawful purpose, to send unsolicited commercial messages outside the missed-call trigger context, or in any way that could damage TradeBird's reputation or infrastructure.
7. Service limitations and disclaimer
TradeBird facilitates the capture and qualification of leads from missed calls. We do not guarantee:
- that every missed call will result in an SMS being sent (for example, if caller ID is blocked or the number is not supported by the SMS provider);
- that every SMS sent will be received, read, or replied to by the caller;
- that qualified leads will result in booked jobs, completed work, or revenue for your business;
- that AI-generated responses will be accurate, complete, or appropriate in every circumstance; or
- that the service will be available 100% of the time, or that it will be free from errors or interruptions.
TradeBird is a lead capture tool, not a sales guarantee. Results depend on many factors outside our control, including the quality of incoming enquiries, your responsiveness, and market conditions.
8. Data and privacy
Your use of TradeBird is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using TradeBird, you agree to the collection and processing of personal information as described in that policy.
You acknowledge that SMS conversation data, caller phone numbers, and lead details will be stored on TradeBird's infrastructure (hosted by Supabase) and processed by third-party service providers including Kudosity/TransmitSMS, Twilio, and Anthropic's Claude API, as described in the Privacy Policy.
9. Limitation of liability
To the maximum extent permitted by Australian law:
- TradeBird's total liability to you for any claim arising under or in connection with this Agreement is limited to the total fees paid by you in the three months immediately preceding the event giving rise to the claim.
- TradeBird is not liable for any indirect, consequential, incidental, special, or punitive damages, including lost profits or lost revenue, arising from your use of or inability to use the service.
- TradeBird is not liable for the content of AI-generated SMS messages sent to callers on your behalf, beyond our obligation to provide the service with reasonable care and skill.
Nothing in this Agreement excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be excluded, restricted, or modified.
10. Term and termination
This Agreement commences when you complete the TradeBird onboarding process and continues on a month-to-month basis until terminated by either party.
Cancellation by you: You may cancel your subscription at any time through your dashboard or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to the service until that date.
Termination by TradeBird: We may suspend or terminate your account immediately if you breach this Agreement, fail to pay fees after notice, or use the service in a manner that is unlawful or harmful to others. We may also terminate your account with 30 days' written notice for any other reason.
Effect of termination: On termination, your access to the TradeBird dashboard and service will cease. Clauses 7, 9, 11, and 13 survive termination.
11. Your data on cancellation
- Your lead records, conversation transcripts, and dashboard data will be retained for 90 days after your final billing date, during which time you may contact us to request an export of your data.
- After 90 days, your data will be permanently deleted from our systems, subject to any legal obligation to retain certain records.
- We will not charge you for data export requests made within the 90-day retention window.
12. Changes to this agreement
We may update this Agreement from time to time. When we do, we will revise the "Last updated" date at the top of this page and notify you by email at least 14 days before the changes take effect. Continued use of TradeBird after the effective date constitutes acceptance of the updated terms. If you do not accept the changes, you may cancel your subscription before they take effect.
13. Governing law
This Agreement is governed by the laws of Queensland, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for the resolution of any dispute arising under or in connection with this Agreement.
